These Terms of Service ("Terms") govern your access to and use of any photographic works, services, or digital content provided by Aperture by Gio LLC, whether through our website, social media platforms, or any other medium.

By booking, purchasing, downloading, or using any photos or services from us, you agree to be bound by these Terms.

1. Ownership & Copyright
All images, videos, and other creative works produced by Aperture by Gio LLC are the intellectual property of the original photographer and are protected under U.S. and international copyright laws. Unless explicitly stated otherwise in a signed contract or license agreement, all rights are reserved to the original photographer.

2. Photo Usage Rights
When you purchase or are provided photos by Aperture by Gio LLC, you are granted a limited, non-exclusive, non-transferable license for personal or commercial use, based on the agreed scope of the project or licensing terms. This does not transfer ownership of the images.

You may NOT:

  • Resell, license, or distribute the photos in any form without written permission.

  • Claim the photos as your own.

  • Use the photos for AI training, NFTs, or similar use cases without prior agreement.

3. Photographer Credit
You must credit the original photographer, Aperture by Gio LLC, in any public or online usage of the images (e.g., social media posts, websites, marketing materials), unless otherwise agreed in writing.

Failure to provide proper credit will result in a formal DMCA takedown notice being issued to the infringing platform, website, or social media account.

Proper credit must appear as:
Photo by Aperture by Gio LLC or @captured.by.gioo (on social media or any social channels).

4. Unauthorized Sale or Distribution
Any unauthorized attempt to sell, distribute, license, or profit from photographs taken by Aperture by Gio LLC, either digitally or in print, will result in legal action including but not limited to:

  • Issuance of cease and desist orders

  • Claims for monetary damages

  • Pursuit of legal remedies in accordance with copyright law

5. Booking, Payment, and Cancellations
All sessions require a deposit to reserve your date and time. Full payment terms and cancellation policies are outlined in your booking contract or invoice.

6. Payment Deadlines
For clients with payment terms of Net 30 or Net 90, full payment is due before the due date outlined in the signed contract or invoice. If the due date passes and no attempt at payment has been logged, legal action will be pursued as outlined in the signed contract. This may include but is not limited to:

  • Issuance of a demand for payment

  • Late fees or penalties

  • Pursuit of monetary damages through legal channels

By signing the contract, both parties agree to these payment terms, and failure to adhere to them will result in legal enforcement.

7. DMCA Enforcement
Aperture by Gio LLC actively monitors the misuse of its content. We reserve the right to file Digital Millennium Copyright Act (DMCA) complaints for any unauthorized use, duplication, or uncredited display of our work.

8. Limitation of Liability
We are not liable for indirect, incidental, or consequential damages resulting from the use or misuse of our content or services.

9. Changes to These Terms
Aperture by Gio LLC reserves the right to modify these Terms at any time. Updated versions will be posted on our website, and continued use of our services constitutes acceptance of those changes.
